Employee protests when boss insists on paying them weekly, repeatedly pays them late because he's out of office on Fridays:

  • Is it unreasonable to ask my boss to send my weekly earnings a day after I’m supposed to receive them?

He hired me on as 1099 so I could get paid weekly. This was before I knew what that truly meant in terms of taxes, and I regret agreeing to this payment set up SO much.
  • The agreement is every Friday before I leave, he writes a physical check from his business account for my hours that week.
  • Well, he isn't always in office on Fridays, and every. single. time. that he isn't, I don't get paid on Fridays.
  • The last time this happened, I was texted him by 3PM on Saturday because my lack of pay was legitimately cutting into my weekend errands and all my autopay made my bank account negative.
  • Long story short, before he left to Hawaii last Thursday, he asked how I wanted to get paid for that week and asked if he could add last Friday to this Friday's check, citing the last time "I was blowing him up saying 'hurry up and pay me!
  • I have plans! Pay me now!' and he doesn't want it to be like that again".
  • He said this in front of my subordinate in a pretty mocking tone. It legitimately made it difficult to work for the rest of the day due to embarrassment.
  • Well, it's 10:20 AM on Saturday now, he's still in HI, my bank account is dry and I have more autopay coming out whenever the bank decides to pull it (EFT can be slow sometimes).
  • I seriously need advice. He pays the only other person that works in our office the same way, and she was totally quiet when he mocked me about the last time we got paid late.
  • After he left the building I tried to talk to her about it to assure her that I would never talk to my superior that way and try to get her opinion, she still was just shut down and had nothing to say.
  • So now I feel like I'm crazy for thinking that it isn't okay the way that he spoke to me or the act of neglecting to pay us on time to begin with as being unacceptable?

  • ManufacturerWest 1760 I would be looking for work. It's unreasonable for him to not have a system in place to pay on time every time. It also sounds like this job doesn't really pay you well so I'm not sure why you would put up with it.
  • gtfofr Original Poster's Reply It's better than not having a job at all, and I haven't found another to fall back on yet
  • StuffonBookshelfs You probably should not be a 1099 employee at all. You should consult a tax professional to make sure that you're not going to get slammed with taxes when you go to file (amongst other things).
  • Hen Tee Tee No pay = no work... Unless you like working for free.
  • gtfofr Original Poster's Reply That's what I was thinking, that I just won't go in on Monday if I don't get paid this weekend. But then his reaction to that could lead to more toxicity or punishment and I'm not trying to bite the hand that feeds me.
  • gtfofr Original Poster's Reply This is a small family owned business so there is no HR
  • notreallylucy First step is turn off autopay. Pay all your bills manually until you find another job. Next step is establish an emergency fund that you can pull from for emergencies like not getting paid. I know that might not be easy because it sounds like your close to maxed out on your income. Try to cut back anywhere you can so you can save even just $20 every week.
